Criminal charges were dropped against a former Jay School District bus driver on May 31, according to online records.
Clifford Niehus, 34, of Jay appeared in court on May 30 for the continuation of his preliminary hearing on two counts of lewd molestation.
Winston Connor II, Niehus’s attorney, declined to comment after the state dropped the charges.
According to a probable cause affidavit, two children told investigators Niehus “slapped them on the butt” and “squished” their butts and “pinched” their butts with his hand. Niehus told investigators he was unloading the students from the bus and some of the children were saying good-bye and other children were giving him the “high-five”.
He looked downwards and was shutting down the heater controls when he felt somebody tap his shoulder and he immediately reached out and tapped a student next to him, the affidavit states.
He noticed the student “looked at him funny” and continued off the bus.
