JAY — A preliminary hearing for a Grove man accused of raping and impregnating a 14-year-old girl is set for April 3.

Timothy Joe Mountford, 51, is charged in Delaware County District Court in Jay with second-degree rape and child sexual abuse, both felonies. He is free on $150,000 bail since charged in November 2007.

Mountford was ordered to pay $203 a month in child support and $51 a month toward the $1,624 due in past child support after a DNA test showed there is a 99.99 percent chance he is the father of an infant girl born to the victim in May 2008. 

According to a petition filed by the Department of Human Services, Matina Garner, Mountford’s adult step-daughter has cared for the infant girl since her birth and is seeking to adopt her.

Gardner has been a foster parent since Feb. 3, 2005, DHS officials confirmed.

According to an affidavit warrant signed Sgt. Mark Sheridan, Grove Police Department detective Mountford confessed to his wife, Vicki Mountford, he had sex with the victim, the affidavit states.

The victim was placed with Timothy and Vicki Mountford in a legal guardianship after she was raped and impregnated when she was 11 years old.

In that case, Tommy James Isbell, 36, of Jay pleaded guilty to four counts of first-degree rape and 12 counts of forcible sodomy and was sentenced to life, court records show.

Isbell confessed to having sex with the child since she was 9-years-old, but stated the sexual activity was consensual, according to a Jay Police Department investigative report.
