JAY – A Colcord man accused of rape will get his day in court March 3.
Rotriko Simon Liwy, 34, was set to enter into a plea agreement with the state on January 12, but instead opted for a jury trial after appearing before Judge Robert Haney during the felony disposition docket Monday afternoon.
Liwy stands accused of rape in the first degree and rape by instrumentation after an alleged incident at his residence in Colcord on October 14th.
According to the affidavit for arrest, the victim was taken to Integris Grove General hospital where bruises were found on her body along with other evidence of the attack.
The suspect reportedly told investigators that he had been drinking, was very drunk and did not remember very much of the incident.
A criminal history check on Liwy revealed that he had been arrested for driving while intoxicated on two occasions, possession of paraphernalia twice and child endangerment three times.
Liwy remains incarcerated in lieu of a $100,000 bond.
