JAY – An Afton man is facing charges of sexually abusing a teenage girl.
James Allen Mister Yates, 42, of Afton was formally charged with child sexual abuse, rape in the second degree, rape in the second degree by instrumentation and forcible oral sodomy, all felonies, on Aug. 18.
According to the affidavit for issuance of arrest warrant, Delaware County Sheriff’s Deputy Dan Wheatley investigated allegations of sexual abuse to an 11-year old girl who had been in Yates’ care. The victim claimed that Yates had sex with her starting at age 11 and ending when she was approximately 15 years old.
Deputy Wheatley interviewed the suspect in March 2009 during a court proceeding in Craig County. Yates denied the allegations and was “confused and shaken” by questions asked by the deputy, according to his report.
A medical examination of the victim showed that she had been sexually active for “some time,” and had contracted a sexually transmitted disease, according to the report filed.
Yates was arrested on Friday and a bond was set at $80,000.
It was reduced to $20,000 on Wednesday and he was released with a court order not to have contact with the victim.
He will return to district court on October 5 at 9:30 a.m. for announcement.
