JAY - A Grove man was found guilty Monday of rape and sexual abuse in a case in which a 14-year-old girl in his legal custody became pregnant.

Tim Mountford, 53, entered a blind plea before District Judge Robert Haney in Delaware County District Court to second-degree rape and child sexual abuse.

Haney found Mountford guilty after he confessed to raping the juvenile in 2007, which resulted in a pregnancy. Mountford was ordered to pay child support after a paternity test determined a 99.99 percent likelihood he is the father of the child, who turns 3 on May 28. Matina Garner, Mountford’s stepdaughter, is attempting to adopt the child.

Mountford’s trial was to begin Monday. Formal sentencing is set for June 1.

Winston Connor II, Mountford’s attorney, described his client as “slow and doesn’t process things like other men his age.” “He’s more easily confused,” Connor said. Connor said despite his client’s mental and psychological issues he has always accepted responsibility for the situation.

The victim, now older than 17, was pleased with the outcome of the hearing and that she would not have to testify at trial, said Nick Lelecas, assistant district attorney.
