A Jay School District bus driver accused of inappropriately touching two elementary girls during the spring semester has been charged in Delaware County District Court. 

Clifford Niehus, 33, of Jay is charged with two counts of lewd molestation. His is free on $10,000 bail, court records show.

Winston Connor II, Niehus’s attorney, declined to comment.

Larry Shackleford, Jay's superintendent, said Niehus resigned before the end of the spring 2018 semester. He is no longer employed by the district.

About the incident 

The alleged acts occurred in April, according to a probable cause affidavit.

The two children told investigators Niehus “slapped them on the butt” and “squished” their butts and “pinched” their butts with his hand, the affidavit states.

 Niehus told investigators he was unloading the students from the bus and some of the children were saying good-bye and other children were giving him the “high-five”.

He looked downwards and was shutting down the heater controls when he felt somebody tap his shoulder and he immediately reached out and tapped a student next to him, the affidavit states.

He noticed the student “looked at him funny” and continued off the bus.

Niehus said he didn’t recall if he touched the student’s legs, butt or back, but did deny pinching the student on the butt.
